If a work went out of copyright before the 1986 act extended copyright terms from 30 years to 50 years, it does not regain copyright. Hence, works where all authors died before 1956 are out of copyright. (See Yunjeong Choi, Development of Copyright Protection in Korea: its History, Inherent Limits, and Suggested Solutions, Brook. J. Int'l L. 28 (2003), pp. 643-673.)
The protection period of neighboring rights shall come into effect from the following date and continue to subsist for a period of 50 years from the next year of such date:
1. For stage performances when the stage performance takes place;
2. For phonograms when the first fixation of sounds is made; and
3. For broadcastings when the broadcasting is made.
I have edited the text as this. Major amendments were enacted in 2011, where the protection period of copyrighted works will be extended from 50 to 70 years effective 1 July 2013. However, works of which copyrights expired prior to this date will not be affected by the amendments.[1] Since most of the commons files tagged with template will be still in the public domain, the original pre-2011 text should be informed to the public in order to avoid misleading deletion requests. Even if the new law takes effect in 2013, works protected by it will not be commons-compatible until 2033. --トトト (talk) 13:11, 13 November 2012 (UTC)[reply]
In Copyright Act of South Korea in 1957, Copyright of Photo shall be effective during 10 years from the publishing date. And these clauses were amended after in Copyright Act of South Korea in 1986 commenced 1-1-1987. So, I believe the copyright of Photo published before 12-31-1976 in South Korea is now public domain. As my English is not very good, please help me fix this template. HappyMidnight (talk) 04:14, 5 July 2013 (UTC)[reply]

Photo taken by foreigner before 12-31-1976 in South Korea
Just note that prior to 2013-07-01 the copyright was death+50years, which means it may be more permissive in some cases. — regards, Revi11:15, 11 December 2016 (UTC)[reply]
Based on the discussion archived in the VP above, I can see Copyright act (No. 432, 1957-01-28) article 35 gives photos only 10 years of copyright, and it was valid until Copyright act (No. 3916, 1987-07-01) article 36 says, so since 1987-10=1977, and rounding up for months, this gives us 1976, yes? But what about 1963?Also, what about anonymous works? Did you ever hear back from that lawyer you were going to contact? The best I found so far from my lawyer friend is that we have to ask Korean Ministry, which means by default any anonymous work published in Korea would be not free after 1976).
According to Articles 39 to 44 of the Copyright Act of the South Korea, under the jurisdiction of the Government of the South Korea, all copyrighted works enter the public domain 70 years after the death of the creator (there being multiple creators, the creator who dies last) or 70 years after publication when made public in the name of an organization. (30 years before July 1987, 50 years before July 2013) In other words, works of which authors died before 1 January 1963, or made public in the name of an organization or in anonymous and pseudonymous before 1 January 1963 are in the public domain in South Korea.
However, according to Article 36(1) of the Copyright Act (No. 3916, 1 July, 1987), the property rights in a work which is first made public in more than 40 years and not exceeding 50 years after his death, shall continue to subsist for a period of 10 years after it is made public. (This applies to works that were in the public domain between July 1987 and July 2013.)
There are exceptional cases. According to Articles 49 of the Copyright Act, property rights are to belong to the state according to provisions of the Civil Law and other laws upon the death of a copyright owner without heir or, in the case of a legal person or organization, upon its dissolution.
You must also include a United States public domain tag to indicate why this work is in the public domain in the United States.
Note that a few countries have copyright terms longer than 70 years: Mexico has 100 years, Jamaica has 95 years, Colombia has 80 years, and Guatemala and Samoa have 75 years. This image may not be in the public domain in these countries, which moreover do not implement the rule of the shorter term. Honduras has a general copyright term of 75 years, but it does implement the rule of the shorter term. Copyright may extend on works created by French who died for France in World War II (more information), Russians who served in the Eastern Front of World War II (known as the Great Patriotic War in Russia) and posthumously rehabilitated victims of Soviet repressions (more information).

Accroding to the Article 2(1) of Supplemental Provisions of Copyright Act (No. 3916, 1 July 1987) and Article 35(1), 36, 37, 37 of Copyright Act (No. 432, 1 July 1987), with the exceptions of photographs reproducing otherwise copyrighted works of art, and photographs inserted into a work of study or art and produced only for the purpose of inclusion within said work, photographs or other works of a similar form to photography either published or produced in before 1 January 1977 are now in the public domain in the South Korea as their term of copyright has expired there.
This work is in the public domain in the United States because it meets three requirements:
it was first published outside the United States (and not published in the U.S. within 30 days),
it was first published before 1 March 1989 without copyright notice or before 1964 without copyright renewal or before the source country established copyright relations with the United States,
it was in the public domain in its home country (South Korea) on the URAA date (1 January 1996).

(e.g. {{PD-Korea-1910-1945}})
{{PD-South Korea}}의 경우 영어와 한국어 본문에 차이가 존재하는 부분을 수정했습니다. 또한 1987년 7월 1일 전에는 사후 30년까지만 보호가 되었으므로 해당 내용을 수정했습니다.
I suggest renaming and modifying the content of the templates as above for the following reasons:
Since there are two Koreas, I believe the name "Korea" should only be used for both South and North Korea, or for Korea before 1945 (e.g., {{PD-Korea-1910-1945}}).
In the case of {{PD-South Korea}}, I made changes to address the differences between the English and Korean texts. Additionally, since it was specifically ADY+30 years before July 1987, I have updated the template accordingly.
I made separated template for photos before 1977. In most cases, they are in the public domain before the URAA, so I also added {{PD-1996-text}}. The same template can be used in {{PD-Korea-1910-1945-photo}}.
I also made template for anonymous works, since it is worth to categorize them separately. Category:PD-anon license tags
Support Seems like reasonable changes. Just one caveat, with PD-South Korea should address that cinematographic works are publish + 70 years not death + 70 (and if not published within 50 years from creation, copyright is creation +70. This is the same for organizational works). Takipoint123 (💬) 21:59, 18 March 2025 (UTC)[reply]
